The Hon'ble Sri Justice C.V.Nagarjuna Reddy

Writ Petition No.12302 of 2013

Dated 23.04.2013

Between: E.Krishna …Petitioner And The Principal Secretary, Panchayat Raj Dept., Govt. of Andhra Pradesh A.P.Secretariat, Hyderabad and 4 others. …Respondents Counsel for the petitioner: Mr.Bollam Lingaiah Yadav Counsel for respondent Nos.1 to 4: AGP for Panchayat Raj Counsel for respondent No.5: Mr.P.Raghavender Reddy, SC for Gram Panchayat

The Court made the following:

Order:

The grievance of the petitioner in this Writ Petition is that even though G.O.Ms.No.220, Panchayat Raj and Rural Development (Elections) Department, dated 25-05-2006, provided for reservation to the extent of 18.30% in favour of Scheduled Caste (SC) community in all elective offices in the local bodies, only one post of Sarpanch was reserved for SC community in respect of Qutbullapur Mandal in the year 2006. According to the petitioner based on the population, 2 posts of Sarpanch have to be allotted for SC community in Qutbullapur Mandal. The petitioner and various others claimed to have made representations to various authorities including respondent Nos.2 and 3.

Inasmuch as the matter of reservation in the elective offices falls in the realm of administrative function, it is appropriate that respondent Nos.2 and 3 examine the grievance of the petitioner and others in the light of the G.O. referred to above, take a decision thereon and communicate the same to the petitioner within a period of four weeks from the date of receipt of this order.

Subject to the above direction, the Writ Petition is

disposed of.

As a sequel, WPMP.No.15201 of 2013, filed by the petitioner for interim relief, is disposed of as infructuous.

C.V.Nagarjuna Reddy, J
