This application is filed under Section 5 of the Limitation Act by the applicant seeking to condone the delay of 185 days, which is caused in filing the O.J.Appeal against the order dated 25.2.2022 passed in Company Application No.268 of 2015 in Company Petition No.415 of 1997.

  1. Heard learned advocates for the respective parties.

  2. We have considered the submissions canvassed by the learned advocates for the respective parties. We have perused the reasons stated in the memo of application and the cause for not preferring the appeal within a period of limitation, more particularly, paragraph 5 of the application. The delay being procedural delay, sufficient cause is made out by the applicant.

  3. In that view, delay is condoned. Rule is made absolute accordingly.
