ORAL ORDER

This petition is directed against order dated 28.12.2015 bearing Reference No.Ijar/Legal/File No.209/2011/723-727, being the impugned order. Thereunder respondent No.2-Chief Controlling Revenue Authority has exercised powers under Section 53A of the Gujarat Stamp Act asking the petitioner to pay the deficit stamp duty of Rs. 34,99,800/- after adjusting Rs.200/- paid initially. The said stamp duty is sought to be charged under Article 36(c) on the instrument which is a Deed of Additional Security in relation to original transaction furnished by the petitioner to the Bank upon realignment of the repayment schedule of the financial assistance taken from the Bank.

  1. For the reasons recorded in the main Special Civil Application No.2480 of 2016, Notice, returnable on 15th March, 2016.

  2. By way of ad-interim relief, respondent authority shall not take any coercive step pursuant to the impugned order.

Direct service is permitted.
