================================================================ CORAM: HONOURABLE THE ACTING CHIEF JUSTICE MR. VIJAY MANOHAR SAHAI and HONOURABLE MR.JUSTICE R.P.DHOLARIA
Date : 25/03/2015 ORAL ORDER (PER : HONOURABLE THE ACTING CHIEF JUSTICE MR. VIJAY MANOHAR SAHAI)
-
We have perused the letter dated 12.02.2015 of the Assistant Registrar, Supreme Court of India, wherein he has informed the Registrar of this Court that various writ petitions, wherein the question of accredition of concerned environment consultant and Office Memorandum issued by Ministry of Environment and Forest has been challenged, is engaging attention of the Apex Court. We have been informed by learned advocate Mr.Bhargav Karia, learned advocate Mr.Shakeel Qureshi, learned advocate Mr.Dipen C.Shah, learned advocate Mr. Anshin H.Desai and learned advocate Mr.Nilesh P.Shah that the transfer applications have been filed in all the aforesaid matters except Special Civil Application Nos.4729 of 2015 and 4730 of 2015 for transferring the matters to the High Court. Though the transfer order has not been passed by the Apex Court but show cause notice has been issued. So far as in Special Civil Application Nos.4729 of 2015 and 4730 of 2015, which were filed before this Court, is concerned, the above fact regarding transfer of other similar Writ Petitions were not brought to the notice of this Court.
-
In view of the above, it is open to the parties to move an application before the Apex Court for transferring these two Writ Petitions being Special Civil Application Nos. 4729 of 2015 and 4730 of 2015 to the Apex Court.
-
The learned counsel for the petitioner has requested to grant interim relief in the above two matters. We are of the considered opinion that no interim relief can be granted in these matters as judicial propriety demands that no interim order should be passed at this stage since the attention of the Apex Court is engaged in similar type of writ petitions. Therefore, in view of the
above, list these matters on 17.6.2015.
