ORAL ORDER

Mr. Mihir Thakore, learned Senior Advocate appearing on behalf of Mr. Mandeep Singh Saluja appearing for petitioner submits that since a provision is made under the agreement for pre-mediation prior to invoking of Arbitration Clause namely Clause 13.1(iii) which provides for such procedure and as such he seeks leave of the Court to withdraw this petition and approach this Court in the event of situation for seeking appointment of Arbitrator were to arise.

Placing his submission on record, the petition is dismissed is withdrawn. It is made clear that in the event of dispute not being resolved, petitioner would be at liberty to approach this Court for the relief of appointment of Arbitrator by filing fresh petition.
