ORAL ORDER

- RULE. Learned Additional Public Prosecutor waives service of Rule on behalf of the respondentState.

- The present application is filed by the under trial prisoner, seeking temporary bail for a period of 30 days in connection with C.R. No.I-11202046200350 of 2020 registered with JAMNAGAR PANCHKOSHI 'B' DIVISION POLICE STATION, DISTRICT JAMNAGAR, on the ground of Bismilla ceremony / Sunnat Shadi ceremony of son of the under trial prisoner. The said ceremonies are to commence from 28032021 to 30032021. It is submitted that the presence of the under trial prisoner is required at this stage. The Invitation Card is annexed with this application.

- Learned APP submitted from the jail report that the applicant is involved in the offence punishable under Sections 307, 506(2),
120(B) of the Indian Penal Code, under Section 25(1b), (a) of Arms Act and under Section 135(1) of G.P. Act. The jail conduct is also reported to be good.

- In view of the aforesaid facts and considering the jail report and Invitation Card, the application is partly allowed. The under trial prisoner is ordered to be released on temporary bail for a period of 2 (Two) days under the Police Escort at the cost of the State from the date of his actual release, on his furnishing a personal bond of Rs.10,000/ (Rupees Ten Thousand Only) to the satisfaction of the jail authority, and on a further condition that he shall surrender to the Jail authorities on expiry of the temporary bail period.
