Heard Mr. N. Taje, learned counsel for the petitioner. Also heard Mr. T. Bayor, learned Addl. Public Prosecutor for the State of Arunachal Pradesh and Mr. K. T
ama, learned counsel appearing for the informant/respondent No. 2.<br>This application under Section 439 Cr.P.C. has been filed on behalf of the accus ed, namely, Sri Nako Hana for his bail in Doimukh Police Station Case No. 15/201 4 under Sections 171F/468/426 of the IPC. Said accused Sri Nako Hana is in cust ody since 22.04.2014.
Perused the Case Diary as well as the Status Report submitted to day by the lear ned Addl. Public Prosecutor, Arunachal Pradesh.
From the perusal of the same, this Court is of the opinion that further custodia l detention of the petitioner is not required for his interrogation to investiga te the said Doimukh P. S. Case No. 15/2014. Considering the same this bail appl ication is accepted.
Accordingly, the accused, namely, Sri Nako Hana shall be released on bai l in Doimukh P. Š. Case No. 15/2014 under Sections 171F/468/426 of the IPC on fu rnishing a bail bond of Rs. 50,000/- with 2 local sureties of the like amount to
the satisfaction of the learned Chief Judicial Magistrate, in-charge, Yupia, It anagar on conditions, that the petitioner shall not leave the territorial jurisd iction of learned Chief Judicial Magistrate without his prior written permission ; shall co-operate with the Investigation Officer of the Doimukh P. S. Case No. 15/2014 and shall appear before him whenever he is required for such purpose ; shall not threat and /or intimidate the informant and/or witnesses of the case and further shall not hamper and/or tamper any evidence of the case.
Any violation of the aforesaid terms and conditions by the accused, name ly, Sri Nako Hana, bail granted to him in Doimukh P. S. Case No. 15/2014 shall s tand automatically vacated.
In terms of the above, this application stands disposed of. Return the Case Diary and the Status Report, herewith.
