Heard Mr.U.K.Nair, learned Standing Counsel, Gauhati High Court. Also heard Mr.B .B.Gogoi, learned Standing Counsel, Finance Department, Mr.S.Sarma, learned Stan ding Counsel, SSA and Mr.SM Chistie, learned Standing Counsel, Elementary Educat ion Department.

This Court directed the Finance Department of the State to indicate the number of Lower Primary and Upper Primary Schools under each of the Treasuries o f the Districts including the District Treasury and Sub-Treasuries of each of th e districts of Assam.

Though the Finance Department on 30.09.2016 have filed an affidavit indi cating the numbers of Lower Primary and Upper Primary schools in each of the d istricts of State of Assam, but the said affidavit did not reflect the number of such primary schools under the District Treasury and Sub-Treasuries of those 2 7 districts.

In view of the above, the Commissioner & Secretary, Finance Department, Govt of Assam shall file a detailed affidavit specifying the number of Lower Pri mary and Upper Primary schools in each of the District Treasuries and Sub-Treasu ries alongwith the names of the schools for the respective districts of State of Assam.

List on 31.01.2017.

Copy of this order be furnished to Mr.B.B.Gogoi, learned Standing Counse l, Finance Department, Assam as well as Mr.U.K.Nair, learned Standing Counsel, Gauhati High Court.

In the meanwhile other respondent i.e SSA and Elementary Education Depar tment, Assam shall file their affidavit.
