Heard Mr. A. Boro, learned counsel for the applicant.

2. The interlocutory application is preferred by the applicant who is the

petitioner in the connected contempt petition, Cont.Case[C] no. 678/2022, for impleadment of the following authority :

"Akash Deep, IAS Principal Secretary, Bodoland Territorial Council Kokrajhar"

as a party-respondent no. 2 in the connected contempt petition, Cont.Case[C] no. 678/2022.

3. It is averred that the authority who was impleaded as the sole respondent in Cont.Case[C] no. 678/2022, has, in the meantime, been transferred from the office of the Principal Secretary, BTC and in his place, the proposed partyrespondent no. 2, mentioned hereinabove, has joined. It is averred that the contempt petition i.e. Cont.Case[C] no. 678/2022 has been preferred alleging disobedience of the direction made in an order dated 04.02.2022 passed in the writ petition, W.P.[C] no. 652/2022. It is also averred that a copy of the Order dated 04.02.2022 [supra] has already been brought to the notice of the proposed respondent no. 2 by submitting a representation dated 03.07.2023.

4. Having regard to the above averments, this interlocutory application is allowed.

5. Registry to cause necessary correction in the cause-title of the connected contempt petition, Cont.Case[C] no. 678/2022 by impleading

"Akash Deep, IAS

Principal Secretary,

Bodoland Territorial Council Kokrajhar" as party-respondent no. 2 therein

and thereafter, list the contempt petition, Cont.Case[C] no. 678/2022 after a week.
