Case taken up before the Lawazima Court.

None appears on behalf of the petitioner.

Perused the records.

The office note dated 12.12.2023 reveals that notice was issued to the respondent No. 4 by registered post with A/D as well as by usual Court process on 09.10.2023 & 10.10.2023 respectively.

Now, in regard to the notice issued by registered post with A/D, it appears that neither the A/D card nor the un-served notice has been received back. However, the track consignment report available with the case record reveals that the notice has been delivered to the addressee on 16.10.2023.

Further, in regard to the notice issued by usual process, it appears that the service report has been received back. As per the said service report, notice has been received by an employee of the respondent No. 4 and the said employee acknowledged the receipt of the notice by putting his/her signature along with the official seal on the return copy of the notice. As such, service is complete in respect of the respondent No. 4.

In view of the above, the matter may be placed before the Hon'ble Court.
