WP(C) 6869/2015 BEFORE HON'BLE MR. JUSTICE UJJAL BHUYAN

Heard Mr. A. Rahman, learned counsel for the petitioner and Mr. B. K. Sarma, lea rned Standing Counsel, Social Welfare Department.

By filing this writ petition under Article 226 of the Constitution of India, pet itioner has challenged the legality and validity of the engagement of respondent No. 6 as Anganwadi Worker of No. 263 Nowdarpara Anganwadi Centre under Gauripur

ICDS Project in the district of Dhubri vide order dated 03.09.2015 issued by th e Child Development Project Officer (CDPO). However, a copy of the said order ha s not been annexed to the writ petition.

According to the petitioner, though he had applied for a copy of the said order the same has not been furnished to him. It is stated that during the pendency of this petition, petitioner has filed an Interlocutory Application seeking amendm ent of the prayer portion. By the amendment sought for, petitioner has sought fo r issuance of advertisement for engagement of Anganwadi Worker in the said centr e.

On 17.12.2015, this Court had directed learned Standing Counsel to inform the Co urt as within what time the CDPO, Gauripur would initiate steps for regular enga gement of Anganwadi Worker in the said Centre. On 28.01.2016 time was sought for

by the learned Standing Counsel. Today, when the matter is called upon, learned Standing Counsel submits that he is not posted with the requisite instruction. From the documents placed on record, it is evident that there is no regular Anga nwadi Worker in the said Angnwadi Centre. It appears that respondent No. 6 has b een engaged as a stop gap arrangement.

Learned Standing Counsel fairly submits that for proper and effective implementa tion of beneficial scheme, it is necessary that there should be regular engageme nt of Anganwadi Worker.

Having regard to the above, respondent No. 5 i.e. CDPO, Gauripur ICDS Project is directed to issue advertisement for engagement of Anganwadi Worker in No. 263 Nowdarpara Anganwadi Centre within a period of 6 (six) weeks' from the date of r eceipt of a certified copy of this order. Writ petition is disposed of.
