Heard Mr. S.C. Biswas, learned counsel for the petitioner. Also heard Mr. P.S. D eka, learned State Counsel

The petitioner is a registered society bearing registration No. RS/SPR/242/D/06 of 2009. The petitioner is aggrieved by the decision conveyed vide Annexure-8 le tter dated 20/03/2009. By the said letter, the Commissioner and Secretary to the Govt. of Assam in the Fishery Department intimated the Director of Fisheries th at for the reasons stated in the communication, the petitioner could not be reco mmended to the National Fisheries Development Board. One of the reasons assigned in the communication was that it was a newly registered society with the regist ration only on 04/02/2009. However, it was also provided that the 60 fishermen w hose names were forwarded by the petitioner's society should be considered throu gh the District Fishery Development Officer, Sonitpur.

The writ petition is pending for the last more than 6 years. As noted above, one of the grounds assigned towards non-consideration of the case of the petitioner was that it was a newly constituted society. It is submitted by Mr. Biswas, lea rned counsel for the petitioners that by now it has become quite old and has als o gained experience.

In view of the above, the writ petition is disposed of granting liberty to the p etitioners to approach the respondents for consideration of their case in future .

There shall be no order as to costs.
