By means of this leave application, the appellant has prayed for leave of this C ourt to prefer the appeal arising out of the order dated 09.10.2015 passed by th e learned Sub-Divisional Judicial Magistrate, Bongaigaon in C.R. Case No. 43/201 5 acquitting the accused of the offence under Section 420 of the IPC.

Having heard the learned counsel appearing for the appellant and the lea rned Additional Public Prosecutor, Assam, leave is granted to the appellant to p refer this appeal.

Accordingly, leave petition stands disposed of.

Already the criminal appeal has been registered and as such, no new numb er is required to be registered again.
