There is no appearance on behalf of the appellant. Counsel for respondent states that the appeal was restored subject to payment of Rs.4,000/- which have not been paid. Since restoration of the appeal was conditional and the appellant has not made compliance of that order and has also not cared to appear in this Court. Therefore, the appeal is dismissed in default and also for not making compliance of the orders of this Court.
