CORAM: HON'BLE MR. JUSTICE V. KAMESWAR RAO O R D E R % 06.11.2019

Defendants have been served as per the compliance affidavit. Mr. A.P. Sahay, learned CGSC appears for defendant nos. 22 and 23 and Mr. Azar Qayum, Adv. appears for defendant no.19.

Learned counsel for the plaintiff submits that the present suit relates to the unauthorized screening and broadcasting of the South Africa Tour of India, 2019 on internet through various websites which are termed as "rogue websites". The Department of Telecommunication and Ministry of Electronics and Information Technology in compliance with the earlier orders passed by this court have blocked the access to the "rogue websites" in order to ensure that the illegal screening of the South Africa Tour of India, 2019 does not take place.

Learned counsel for the plaintiffs also states, the ISPs arrayed as

$~5

defendants have also blocked the websites.

Considering the fact that South Africa Tour of India, 2019 has come to an end, learned counsel submits that the Suit itself can be finally decreed and disposed of.

Accordingly, this court is of the opinion that permanent injunction deserves to be granted against all the "rogue websites", i.e., defendant nos. 1 to 10 in any manner communicating, telecasting, broadcasting or indulging in unauthorized illegal online screening of any of the South Africa Tour of India, 2019 events and matches.

The Suit is decreed in terms of prayers Para 50 (i), (ii), (iii), (iv) and (v). Decree sheet be drawn accordingly. Petition stands disposed of.

I take on record the statements made by the counsel for the plaintiffs that he has not pressed other reliefs in Para 50 of the plaint.

All the pending applications are disposed of.
