However, learned counsel for respondents requests for date adjustment as he is not available on 16.07.2024. With convenience of both sides, next date is changed from 16.07.2024 to 23.07.2024. Accordingly, the application stands disposed of.

  1. Final arguments partly heard but are deferred as learned counsel for respondents need some time to examine the issue. Broadly speaking, the learned Rent Controller initially passed an order declining the application for leave to contest but subsequently in review exercise, he reversed the decision, granting leave to contest. The issue today discussed is as to whether in the exercise of review jurisdiction, the court can delve deep into the merits of the case instead of confining itself to the alleged error on the face of record.

  2. Learned counsel for respondents in RC.REV.220/2023 submits that his written submissions fell in defect because the same exceeded the limit by one page. The said written submissions be taken on record.

  3. Relist for final arguments on 23.07.2024.
