  1. This application has been filed by defendant Mr. Rajiv Puri seeking direction in pursuance to para 27 of the order dated 29th September, 2016.

  2. The senior counsel for the applicant/defendant Rajiv Puri states that the flat is required to be repaired to be in a lettable state.

  3. As per my understanding, for letting out of commercial flats, there is no need for any repair work and it is the tenant who does its own interior of flat as per its requirement.

  4. The senior counsel for the applicant/defendant then states that there may be some electricity, water and house tax dues and the same be allowed to be cleared from the money long deposited in certain bank accounts subject matter of these proceedings.

  5. The senior counsel for the legal heirs of Mr. Karan Puri states that they would also be interested in settling the outstanding dues so that the prospective tenant can beneficially enjoy the property and whatsoever is the correct amount, have no objection to the same being paid out of the money lying in the bank account.

  6. The counsels to mutually resolve the said aspect.

  7. The senior counsel for applicant / defendant Mr. Rajiv Puri also states that the duplicate keys of the Flat No.4D, Hansalaya Building, 15, Barakhamba Road, New Delhi be handed over to Mr. Rajiv Puri to show the flat to prospective tenants.

  8. The senior counsel for the legal heirs of Mr. Karan Puri assures that the flat would be opened at three hours notice.

  9. With the aforesaid the application is disposed of.

CS(OS) 766/2006, CS(OS) 935/2007 & TEST.CAS. 3/2008

  1. Though a large number of applications are pending but the counsels are requested to prepare the files for expeditious hearing of all the applications which are to be heard chronologically.

  2. The Registry is directed to within one week make the running pagination of files of each of the proceedings.
