By way of this application filed under Section 482 Cr.P.C. the applicant/complainant Mr.D.P.Arya is praying for releasing the amount of FDR/Pay Order No.007036 dated 14th February, 2008 for ₹5 Lakh deposited by petitioner Ranpal Singh in compliance of the orders dated 8th February, 2008 which reads as under:

'Notice, which is accepted by the learned APP.

On hearing learned counsels for the parties and taking into consideration the nature of the transaction as also the fact that the only reason cited for custodial interrogation is for recovery of Rs.5.00 lakh given to the petitioner for renovation of the property and on the petitioner volunteering to depositing a sum of Rs.5.00 lakh in Court within ten (10) days, I deem it appropriate to direct that the petitioner shall join the investigation and in case he is arrested he will be released on bail on furnishing a personal bond in BAIL APPLN. 269/2008 page 1 of 2 the sum of Rs.25,000.00 with one surety of the like amount to the satisfaction of the IO/SHO concerned.

Petition stands disposed of. Dasti.'

  1. The application bearing Crl.M.A.9486/2016, filed by the legal representatives of the petitioner seeking release of the amount of ₹5 Lakh deposited by Sh.Ranpal Singh was dismissed vide order dated 27th July, 2017.

  2. Learned counsel for the applicant/complainant has requested that the amount of ₹5 Lakhs be released in favour of the applicant/complainant Mr.D.P.Arya.

  3. In view of the above that the amount of ₹5 Lakhs was deposited by the petitioner to avoid custodial interrogation and recovery of the amount was claimed by the complainant, the application is allowed. The amount of ₹5 Lakh is directed to be released in favour of the applicant/complainant Mr.D.P.Arya along with the interest accrued thereon.

  4. The application is disposed of.
