Bail Appl. No. 866/2020 & CRL. M.B.5910/2020

1. Crl. M.B. No. 5910/2020 is an application for grant of interim bail filed under Section 482 r/w Section 439 Cr.P.C. on behalf of the petitioner Brijesh Kumar in FIR bearing no. 32/2018, u/S. 420, 467, 468, 471, 506, 120B, 174A and 34 IPC, registered at P.S. Shahbad Dairy, Delhi.

2. Status report has been filed by the Ld. APP for the state on the interim bail application. Ld. Counsel for the petitioner, however, submits that he has also filed an additional affidavit.

3. Ld. APP for the state submits that he has not been supplied with the copy of the additional affidavit. Ld. Counsel for the petitioner submits that he will supply the copy of the additional affidavit to the Ld. APP for the state today itself on the email.

4. Ld. APP for the state submits that he will verify the facts stated in the additional affidavit and will file a status report in this regard two days before the next date of hearing.

5. Ld. Counsel for the petitioner further submits that so far as regular bail application of the petitioner is concerned, the same may also be considered in view of the fact that other co-accused have already been released on bail.

6. Ld. APP for the State, however, submits that status report qua regular bail has been filed. However, the same has not been placed on court record. Let the same be placed on record before the next date of hearing.

7. Let detailed status report qua regular bail, status report qua additional affidavit be filed by the petitioner and Nominal roll of the petitioner be also called from jail superintendent two days before the next date of hearing. Let IO also join the proceedings on the next date of hearing.

8. List the matter on 18.05.2020.

9. A copy of this order be uploaded on the website of this court.
