1. After some arguments, learned senior counsel for the plaintiffs, on instructions, seeks to withdraw the present suit with liberty to institute the same afresh in accordance with law.

2. Accordingly, the present suit, alongwith the pending applications, is dismissed as withdrawn, with liberty, as prayed for.

3. Learned senior counsel for the plaintiffs prays for refund of 100% of court fee, as the suit is withdrawn at its nascent stage.

4. This being the first date of hearing, on an oral request made by the learned senior counsel for the plaintiffs, upon instructions received, the

suit is withdrawn at its initial stage, let a certificate of refund of 100% court fee, if already paid on the plaint, be prepared and handed over to the learned counsel for the plaintiffs.
