  1. This is a petition under Section 528 of BNSS/ 482 of the Cr.P.C. for setting-aside the order dated 01.02.2025, passed by the learned ACJM, vide which the application under Section 156(3) Cr.P.C. preferred by the complainant and the application under Section 302 Cr.P.C. preferred by the petitioner has been dismissed.

  2. The learned counsel for petitioner submits that one Smt. Amrita Devi filed a complainant under Section 156(3) readwith Section 200 Cr.P.C. against Mr. Murari Lal Gupta alleging therein that the said accused prepared forged documents in respect of her property. She further alleged that Mr.

Murari Lal Gupta got some of the documents registered in Haryana whereas she never appeared before any Sub-Registrar.

  1. The learned Trial Court directed the Police to submit the Action Taken Report ['ATR'].

  2. During the pendency of the case, complainant Smt. Amrita Devi expired.

  3. The present petitioner filed an application for being substituted as a legal representative on the ground that he was beneficiary of the will executed by Smt. Amrita Devi.

  4. However, the said application came to be dismissed by the impugned order dated 01.02.2025.

    1. Issue notice of the petition to the learned APP.
    1. Mr. Hitesh Wali, learned APP accepts notice on behalf of the State.
    1. Short reply/status quo be filed within a period of four weeks.
