Ld. Counsel for the petitioner submits that along with this petition seeking quashing of FIR, he has also filed an application seeking suspension of sentence of both the petitioners who are required to surrender before the Jail Superintendent on 14th February, 2025 in terms of order dated 14.01.2025 and 18.01.2025 passed by Ld. Sessions Court with respect to order on sentence and suspension of sentence of the petitioners.
He requests that before proceeding further with recording of statements of the parties, let, the matter be placed before Hon'ble Court for hearing of the application for suspension of sentence, failing which the liberty of the petitioners will be at stake despite now there being a compromise between the parties.
Moreover, in any case today the respondent no. 2 is appearing through VC; and her brother, who is also one of the victims in FIR No. 556/20104 registered with PS Kalyanpuri has not been made a party in the petition and he is also not a signatory to the MOU arrived at between the parties, however his NOC for quashing of FIR is on record.
Moreover, there is no vakalatnama of any counsel on behalf of respondents to identify them; and IO is not present, despite advance notice to the state to identify the parties. As such the statement of the respondents to ascertain the veracity and genuineness of parties entering into settlement cannot be recorded today and has to be postponed to a future date.
Accordingly, considering that the liberty of the petitioners is at stake, at request of ld. Counsel for the petitioner list the matter before Hon'ble Court on 14th February, 2025.
Ld. Counsel for the petitioner seeks liberty to place on record orders dated 14.01.2025 & 18.01.2025 on record. Be filed today itself.
