The parties have been briefly heard.

Learned Counsel for the Petitioner has relied upon the Judgment in the case of Delhi Cloth and General Mills Co. Ltd. v. Shri Rameshwar Dyan and Anr.: AIR 1961 SC 689 to submit that in circumstances akin to those in the present case, the Supreme Court, while examining a proposition under Section 33 A of the Industrial Disputes Act, 1947, has set aside the order of the Tribunal.

Learned Counsel for the Respondents on the other hand seeks to rely on the Judgment of the Supreme Court in Jaipur Zila Sahakari Bhoomi Vikas Bank Ltd. v. Ram Gopal Sharma and Ors: (2002) 2 SCC 244 and a Judgment of a Coordinate Bench dated 07.07.2022 in W.P(C) 10290/2022 titled Reena Kumari Gaur & Ors. v. Delhi Cantonment Board & Anr. to submit that status quo should be maintained during the pendency of an industrial dispute.
