For the reasons stated in the application, the application is allowed, the delay of 177 days in filing CM No. 41284/2018 is condoned. The application stands disposed of.

The present applications have been filed in pursuance of the liberty granted to the appellant by the Hon'ble Supreme Court in Appeal (Crl.) No. 12723/2016. We find that earlier the appellant had tendered an apology on June 01, 2016 before a Bench of this Court, which was not accepted by this Court. Now, in terms of the apology submitted by the appellant, the matter needs to be reconsidered.

Keeping in view the aforesaid, we direct that these applications be listed before a Division Bench in which Hon'ble Mr. Justice Najmi Waziri, is a member on 26th November, 2018, as the order of June 01, 2016 tendering the apology was passed by the Division Bench presided over by HMJ Najmi Waziri and now the apology submitted by the appellant in pursuance of the liberty granted by the Supreme Court is in continuation of the said proceedings.
