Heard on IA No.2 which is an application for grant of temporary bail/ad-interim bail to the applicant.
Learned counsel for the applicant submits that father of applicant Late Maksoom Khan died on 02.04.2025 and the last rite (40th day ceremony) is to be performed on 24.04.2025. Ceremony of 40th day has been preponed because marriage in the family is pre-fixed, which is scheduled on 26.04.2025.
Learned counsel for the State submits that after receipt of copy of application, he has verified the facts and according to his information, the reasons assigned in the application are correct. He has also verified the criminal antecedents of the applicant and as per his information, there is no other criminal antecedents of applicant. He also submits that earlier, the prayer of applicant for permitting him to appear burial ceremony of his father has been considered and allowed by the learned trial Court and he has been sent under police custody.
I have heard learned counsel for the parties.
Taking into consideration the facts and circumstances of the case, considering that there is no other criminal antecedents of applicant, investigation is complete, charge sheet has been filed and further considering that application for grant of temporary/adinterim bail is filed by applicant to attend 40th day ceremony of his late father, I am inclined to allow the application.
Accordingly, the application (IA No.2) is allowed and it is directed that the applicant shall be released on temporary bail on his furnishing a personal bond in the sum of Rs.50,000/- with one surety in the like sum to the satisfaction of trial Court concerned.
Applicant shall positively surrender himself before the trial Court on or before 30th April 2025.
