(1) The parties hvea filed compromise petiio tn.

(2) By way of compromise, both the parties, the petitioner and the respondent — Corporation, have agreed that the petitioner, namely Upkar Singh shall be given reinstatement in service without back-wages which is acceptable t0 the petitioner.

(3) Both the parties to the dispute have also agreed upon that they shall not challenge the order of rnstatement of the petitioner and the petitioner, in turn, shall also not challen he non-granting of back—wages, before any forum or Court of Law. ei ge <sup>t</sup>

(4) In View of compromise entered into between the parties, the writ petition stands disposed of and the orders dated 01-08-1998, 23—06-1999 passed by the

Industrial Court, Raipur in Appeal No. 301/MPIR/90 & Reveiw Application No. 80/MPIR/98 as well as 6/10-08-1998 passed by M.P. State Road Transport, Raipur are hereby set aside. The petitioner shall be reinstated in service without back-wages.

(5) It is also brought to the notice of the Forum that the petitioner is already in employment by virtue of interim order passed by the High Court on 11-04-2002. Therefore, the said period of service shall also be taken into consideration for computing the length of service of the petitioner.

(6) The writ petition stands accordingly disposed of.
