2 27-09-2019 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Suspicion is that co-accused Ram Pravesh Choudhary along with other named accused person including the petitioners committed murder of the mother of the informant for land dispute.

Submission is that there is no eyewitness of the occurrence and, save and except suspicion, there is no other material against the petitioners. Co-accused Vijay Choudhary, Manoj Choudhary and Ajay Choudhary have already been

allowed by other Coordinate Benches of this Court vide order dated 13.09.2019 in Cr. Misc. No. 44976 of 2019 and order dated 20.08.2019 in Cr. Misc. No. 51468 of 2019.

Considering the facts aforesaid, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 224 of 2019/271 of 2019 arising out of Haspura Police Station Case No. 37 of 2019, subject to the following conditions:-

(a) The petitioners shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.

(b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
