Challenge in this batch of Letters Patent Appeals is to the common judgment dated 18.05.2018 passed by the learned Writ Court in the batch of writ applications whereby the learned Writ Court has been pleased to quash the impugned circular bearing No. 08 of 2016 and 01 of 2017 dated 17.08.2016 and 17.01.2017 respectively issued by the Food Corporation of India (in short 'FCI' or the appellants).
It appears that the writ applications were preferred by the private respondents in this appeal who claimed that they were the departmental workers working in Food Storage Depot of the different depots of the FCI situated in the State of Bihar. Some of the petitioners were working on the post of Sardar, Mandal and some of them were Handling Labourers in those depots. The petitioners are involved in handling of bags in these depots.
The case of the petitioners before the Writ Court was that while they are entitled to regular monthly pay, apart from that
there is a provision for incentive to them with regard to handling of bags. The incentive scheme is governed by the circulars. In the year 1999 with regard to handling of bags a bipartite settlement was arrived at between the management of the FCI and the Union of the petitioners whereunder apart from other things, piece rate incentive scheme was agreed to be revised. The settlement arrived on 13.03.1999 was enforce by the management vide letter dated 10.05.1999 and the petitioners as well as other workers started getting incentive as per the said order. A copy of the bipartite settlement has been brought on record as Annexure- 2 to the writ petition.
It is further stated that the management of FCI issued a Circular No. 18/2005 dated 15.12.2005 whereby existing norms and incentive which were enforce were sought to be revised unilaterally. We are not going into the rates revised under the settlement and the subsequent rates etc. which are mentioned in detailed in the writ application. It is, however, an admitted position that the incentive scheme circulated by the management vide Circular No. 18 of 2005 was challenged by the Union of the petitioners giving rise to a industrial dispute before the Central Government Industrial Tribunalcum-Labour Court, Delhi.
During the pendency of the industrial disputes the management of FCI issued another Circular No. 05 of 2006, followed
by yet another Circular No. 11/2006 dated 12.04.2006 staying the implementation of the circular dated 18 of 2005 in the following terms :-
"……Therefore, it has been decided by the competent authority that the implementation of Circular No. 18/2005 dated 15.12.2005 with regard to payment of the incentive wages as per revised norms to the departmental workers be stayed till the dispute is pending before the RLC(C), New Delhi."
By the circular dated April 12, 2006, it was provided that the stay of Circular No. 18/2005 is prospective w.e.f. 20.02.2006, as such the past cases of payment of incentive wages to the departmental workers as per revised norms need not be reviewed during the pendency of the Industrial Disputes/Conciliation proceedings.
It is a matter of record that ultimately the reference pending before the Industrial Tribunal-cum-Labour Court, Delhi was answered in favour of the management as the Tribunal held that the FCI is within its power to take policy decision regarding the norms to be followed in loading and unloading of the shacks and that the demand of the FCI workers' Union for withdrawing the new incentive scheme vide Circular No. 18 of 2005 is not legal or justified. A copy of the award dated 05.07.2016 has been brought on record as
Annexure -5 to the writ application. A perusal of Annexure- 5 would show that so far as the reference under Section 10 of the Industrial Disputes Act, 1947 is concerned, it was in the following terms :-
"Whether the demand of the Union of withdrawing the new incentive scheme announced vide Circular No. 18/2005 dated 15.12.2005 is legal and justified? If not, to what relief is the workman entitled ?"
While rendering the award the Tribunal held that in its considered opinion the Government as well as Food Corporation of India are well within its power to take policy decision regarding norms to be followed in loading and unloading of assets etc. The demand of the FCI unions for withdrawing the new incentive scheme was held neither legal nor justified under the law. It is evident from a bare perusal of the award that the Industrial Tribunal does not discuss about any consequence of the declarations so made by the Tribunal on the incentives already paid to the petitioners pursuant to the circular issued on 20.02.2006 (Annexure-4) and 12.04.2006 (Annexure- 4/A). It also appears on perusal of Annexure- 4 and 4/A that these circulars nowhere talk of the payments being made during pendency of the dispute before the Industrial Tribunal will be subject to recovery if the award goes in favour of FCI. In other words, the management of FCI did not give any stipulation in the circular as contained in Annexure-
4 and 4/A respectively that in case the award of the Industrial Tribunal goes in favour of the management, the payments made to the petitioner during the pendency of the dispute will be subject to recovery.
In the aforementioned circumstance, when after the award was passed and the competent authority of the FCI came out with the two circulars impugned in the writ applications seeking recovery of payments already made to the private respondents, they raised their grievance against the recoveries sought to be affected against them.
Before the learned Writ Court the contention of the management of FCI was that the department has rightly issued two circulars for recovery of the excess payment made to the petitioners. It is submitted that the payments were made because of the legal impediment of pendency of an industrial dispute and, therefore, the FCI is entitled to receive back the amount. It is the stand of the FCI that Circular No. 18 of 2005 has now been made effective with retrospective effect because the same was stayed due to statutory requirement and now that the said circular has been held to be valid by the Tribunal, FCI is rightly seeking recovery of the excess payment.
The learned Writ Court, however, rejected the
contention of the management of the FCI who were respondents before the Writ Court and following the ratio of the judgments of the Hon'ble Supreme Court in the case of State of Punjab and others vs. Rafiq Masih, reported in 2015 (4) SCC 334, the learned Writ Court took a view that the decision of the respondents to recover so-called excess amount paid to the workmen in excess under Piece Rated Incentive Scheme for handling bags since 01.12.2005 would be unfair, wrongful, improper and unwarranted and such deduction from salary or retiral benefits of the workman would put them in extreme hardship and would make it difficult for them to provide for the need of their family.
While assailing the impugned judgment Mr. P.K. Shahi, learned senior advocate representing the appellants in all these cases would submit that the learned Writ Court could not appreciate the ratio of the judgment of the Hon'ble Supreme Court in the case of Rafiq Masih (supra). Learned counsel submits that those were the cases in respect of the government employees falling in Class IV category where the Hon'ble Supreme Court was of the view that the payments made to them without there being any misrepresentation or fraud on their part, the same should not be recovered after lapse of considerable time. But, according to Mr. Shahi, the fact situation of the present case is quite different and distinct. It is submitted that the
payments were made to the petitioners during pendency of the industrial dispute when the Circular No. 18 of 2005 was subject matter of reference at the instance of the Central Government and the reference so made to the Tribunal-cum-Labour Court, Delhi was yet to be decided. It is submitted that the petitioners of this case would have well understood that the payments being made to them may be subjected to recovery if the Circular No. 18 of 2005 is held to be valid and justified.
Consideration
We are afraid, the submissions made by Mr. Shahi, learned senior advocate would not appeal us. The facts of the case are crystal clear. Circular No. 18 of 2005 was sought to be implemented w.e.f. 01.12.2005 but because of the disputes raised by the workman/petitioners saying that the said circular is in violation of the terms of bipartite settlement, considering the nature of dispute the Central Government, Ministry of Labour formulated the reference and sent it for adjudication to the Central Government Industrial Tribunal*cum-*Labour Court, Delhi. During pendency of the industrial dispute, for whatever reasons it may be, the management of the FCI on its own came out with Circular No. 5 of 2006 dated February 20, 2006 and Circular No. 11 of 2006 dated April 12, 2006 as contained in Annexure- 4 and 4/A of the Writ Application. By these two circulars
the competent authority of FCI decided that the implementation of Circular No. 18 of 2005 with regard to payment of incentive wages as per revised norms to the departmental workers shall remain stayed till the dispute is pending. Annexure- 4 dated February 20, 2006 refers to the proceeding pending before the Regional Labour Commissioner (Central) which may be at the stage of conciliation when the attention of the management was drawn towards the provisions contained in Section 31 of the Industrial Dispute Act, 1947. It is for this reason that the management stayed operation of its own Circular No. 18 of 2005.
The Circulars nowhere says that the decision to stay the implementation of Circular No. 18 of 2005 and the payments which will be made pursuant to such stay will be subject to the result of the adjudication of industrial dispute before the Tribunal and may be subject to recovery at any stage. If the management of FCI had any intention to recover the amounts which were being paid by virtue of their own Circular No. 5 of 2006 and Circular No. 11 of 2006 a clear stipulation to that effect would have, perhaps benefited the management in supporting their contention at this stage, but for them now it is a matter of past, much water has flown by now, the management has made payments to the workers/petitioners during pendency of the industrial dispute over a period of about 11-12 years. These petitioners are the bag handlers and in the nature of their works,
at this stage if they are called upon to pay back the incentive amount which was paid to them for last 11-12 years, perhaps they will be in a very difficult situation. There is nothing to suggest that even for a minute they could have any idea that after 11-12 years they will be asked to pay back the incentives amount. This Court sitting in its writ jurisdiction cannot ignore the circumstances which it may envisage if the workers/petitioners are directed to refund the entire amount of incentives of last 12 years. The hardships which are likely to be faced by the writ petitioners are not the only ground which this Court is taking into consideration. The larger issue is that the management of FCI having itself implemented the old scheme by issuing Annexure- 4 and 4/A respectively to the writ application during pendency of the industrial dispute or conciliation proceeding without providing any information to the workers that such payments will be subject to recovery, at this stage cannot be permitted to come out with a decision to implement their scheme under Circular No. 18 of 2005 with retrospective effect. In the garb of giving retrospective effect to their Circular No. 18 of 2005, in the given circumstances the management of FCI cannot be allowed either on legal grounds or on equitable consideration to recover the amount already paid to the petitioners.
At this stage, we are of the view that even if the facts
of the case of Rafiq Masih (supra) are different from that of the facts of the present case, the reasoning, logic and the rationale provided by the Hon'ble Supreme Court of India in the case of Rafiq Masih (supra) will equally apply in the case of the present writ petitionersprivate respondents.
We find no merit in these Letters Patent Appeals. All the appeals are, thus, dismissed but without any order as to cost.
