25 13-11-2013 A show cause has been filed today by the Principal Secretary, Education Department, Government of Bihar, Patna. In this show cause decision taken by the State Government and communicated to the Universities under Memo No.1893 dated 22.10.2013 is annexed and its corrigendum under Memo No.1964 dated 31.10.2013 has also been annexed. In effect, what they state, is that the redesignated Demonstrators (in the circulars this expression is consciously avoided) be paid their remuneration in the payscale of Rs.5500-9000 (unrevised) upon revision, notionally with effect from 01.01.2006 and actually with effect from 01.04.2007 the pay-scale would be Rs.9300-34800 with Grade Pay as stated therein. Various other stipulations are there

including verification of academic qualification etc.

In my view, State at last has made substantial compliance of orders of this Court. However, few clarifications are due and are given by this Court. In the judgment under consideration, this Court had clearly noticed and held that after the decision of the State Cabinet in the year 2006 Universities conducted exercises under which academic qualifications etc. of all these re-designated Demonstrators were verified. The matters were considered by the Senate and Syndicate of the Universities and, ultimately, they were, upon scrutiny, notified as such. Upon budget being sent to the State Government, payments were accordingly released. Utilization certificate were issued and further demands were made from the State and they were paid. Now to re-verify their academic qualifications and/or the basis of their employment, i.e., whether sanctioned post existing or not seems to be a bit onerous. I would thus clarify that unless there is an information to the State that any particular person is not qualified and has been employed without sanctioned post which post would include deemed sanctioned post as contemplated by the decision of this Court in the case of Brij Kishore Singh Vs. The State of Bihar & Ors. since reported in 1997(1) PLJR 509 payments of both arrears

and current would immediately start. In the judgment, I have also noticed that the Cabinet decision clearly provided enhanced pay-scale in respect of those re-designated Demonstrators who had requisite educational qualification. The other issue is with regard to the enhancement in pay-scale upon completion of 16 years of service as such. In my view, no occasion has yet arisen to decide whether State is in contempt or not on this issue. It is expected that all these arrears up-todate would be cleared within next two months. It may be pointed out that in course of these litigations large number of re-designated Demonstrators might have superannuated. Universities would be well advised to take special care to clear their arrears and their dues at the first instance without further harassment to them. This order is being passed in presence of learned Principal Additional Advocate General, who appears on behalf of the State, and learned counsels for the Universities and petitioners. It is hoped that so far as these issues are concerned, this would be the end of litigation.

These proceedings are, thus, terminated.
