XVII, submits that since the present writ petition pertains to

a dispute under Section 48 E of the Bihar Tenancy Act, 1885,

and during pendency of the petition for adjudicating such

dispute, an appropriate forum as Land Tribunal has been constituted and functioning, this matter may be referred to the Land Tribunal.

In this case, till date, no order has been passed for issuance of notice to private respondents.

Accordingly, in view of submission made by learned counsel for petitioners as well as in view of provision contained in Section 15 of the Bihar Land Tribunal Act, 2009, the Registry is directed to transmit the record of this case to the Land Tribunal forthwith.
