CORAM: HONOURABLE MR. JUSTICE NAVIN SINHA ORAL ORDER
5 14-09-2012 Heard learned counsel for the petitioners, the State
and for Bihar School Examination Board.
Learned Counsel for the petitioners submits that the dispute of alleged competing claims with regard to the genuine Educational Institutions and consequent entitlement for grant in aid was awaiting necessary report from the Board, called for by the State Government. The report has been submitted on 15.3.2012 available at Annexure 6 to the petitioners' reply to the counter affidavit.
Paragraph 7 of the counter affidavit filed by the Director, Secondary Education, states that as soon as the
report called for from the Board by letter no. 933 dated 30.12.2011 is received, a decision shall be taken.
Learned counsel for the State submits that if the report called for has been received, the writ application may be disposed with directions to take an appropriate decision upon the same.
Let the respondents, in the Department of Higher Education, take an appropriate decision on the report, on all aspects, in accordance with law within a maximum period of two months from the date of receipt/production of a copy of this order.
The application stands disposed.
