Having heard learned Additional Advocate General No.6 and all the counsels representing the respondents, the whole issue can now be wrapped up keeping in mind the decision, which was rendered in the case of Akhauri Bijay Prakash Sinha Vs. State of Bihar, reported in 2014 (2) PLJR 798 as well as the order of the Hon'ble Supreme Court passed in Civil Appeal No (s).6178-6181 of 2015, dated 27.02.2017 and the consequential notification, which the State of Bihar itself has issued, vide letter no.1301, dated 06.07.2017, under the signature of Additional Secretary, Department of Education, Government of Bihar, a copy of which has been produced before this Court.

The latest notification of the Department of Education, which is letter no.1301, will now govern the issue because the State itself has decided to act upon the protection, which has been extended by the Hon'ble Supreme Court while disposing of the Civil Appeal No(s) 6178-6181 in paragraphs 2 and 3, which read as under:

" These appeals arise out of challenge to the Bihar State Universities (Amendment and Validation) Act, 2012 (Bihar Act 22 of 2012) which has been upheld by the High Court by the impugned order. We do not find any ground to interfere with the view taken by the High Court in upholding the said Act.

We however make it clear that the present status, rank and pay of the appellants will not be disturbed. If any lab assistant has been given designation of

demonstrator, which he continues to hold till date, it will not be withdrawn. They will not be entitled to any further benefits in conflict with the impugned Act."

All these appeals stand disposed of now with a direction upon the State authorities that they will abide by the decision dated 06.07.2017 contained in letter no.1301.

Before parting, some of the counsels pointed out that quite a University across the State have not yet implemented or carried out the order of the Hon'ble Supreme Court and even the replacement scales etc. have not been extended till date.

Now that the clarity has been given by this Court in the order passed today, it goes without saying that the State and the University will take a follow up action which they are bound to do.

All the Letters Patent Appeals stand disposed of in view of the above.
