This writ application, under Article 227 of the Constitution of India, filed on behalf of the petitioner, is directed against the order dated 18.11.2009 passed in Title Suit No. 65 of 2002, whereby the leaned Munsif-I, Begusarai, allowed the application dated 18.09.2009 filed on behalf of the defendants/respondents, under Order VI Rule 17 of the code of Civil Procedure, to amend in the written statement.
On perusal of the impugned order, it appears that the defendants/respondents prayed through the amendment petition dated 18.09.2009 to delete the figure '1995' by inserting the figure '1980' in paragraph 11 of the written statement with submission that due to typographical error figure '1995' has wrongly been typed in place of figure '1980' and the learned Munsif-I, Begusarai, allowed the said application on cost arrived at conclusion that this is a typographical error.
Apparently, I find no illegality amounting to abuse of process of court in the impugned order for interference with the same. Accordingly, this writ application is dismissed.
