ORAL ORDER
2 28-01-2014 Heard learned counsels for the petitioner, the State and the informant.
The petitioner is languishing in custody since 02.08.2013 in a case registered for the offences punishable under Sections 366 & 366(A) of the Indian Penal Code.
Accusation against the petitioner is of kidnapping the minor daughter of the informant. In the statement under Section 164 Cr.P.C., the victim has not alleged any misbehaviour against the petitioner and she got her age recorded as 13 years.
It has been submitted by the learned counsel for the petitioner that after 164 statement, the victim was examined by the doctor, and as per the medical report, the age of the victim is 16 to 17 years. It is further submitted that the petitioner is already

married with the victim and the present bail application has been sworn by the victim herself.
It is submitted by the learned counsel for the informant that the petitioner is a married person and is involved in one other case also.
Considering the fact that the present application has been sworn by the victim herself and other accused persons have been granted bail vide Cr. Misc. No. 27968 of 2013 and the period under custody, let the petitioner, named above, be released on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in connection with Chakia P.S. Case No. 321/12.
