  1. Whereas Sri Batchu Bhaskar Rao and Batchu Ramalakshmamma are the husband and wife. They are blessed with five children namely (i)Kotha Seshamma, (ii) Batchu Veeraraju, (iii) Batchu Kmaraju, (iv) Pasumarthi Lakshmikantham, (v) T Vasantha. During their life time, Sri Batchu Bhaskar Rao and Batchu Ramalakshmamma performed the marriages of all their five children. •

  2. During their life time, Sri Batchu Bhaskar Rao acquired the following properties:

(i) "A" Schedule Property situated in Dharmavaram Village, which fell to the share of Bhaskara Rao as per the Partition Deed dated 10-08-2005 registered as Document No: 3155/2005 in the Sub Registrar Office, Prathipadu where under Sri Batchu (Late) Bhaskara Rao and his brothers Viswanadham, Ramayya, Satyanandam and their younger sister-in-law Subba Lakshmi portioned their ancestral properties.

    • The property purchased from. Vadali Narasimha Sastry and registered in the name of Batchu Ramalakshmamma W/o. Batchu Bhaskara Rao vide Sale Deed dt.31-03-1965 registered as Document No:677/1965 at Joint Sub Registrar Office, Pithapuram.

(iv) The property purchased from Malyala Suryanarayana Murthy and registered in the name ofBatchu Rama Lakshmamma W/o. Batchu Bhaskara Rao vide Sale Deed dt.29-10-1979 registered as Document No:2874/1979.

Apart from these immovable properties, an amount of Rs. 15,00,000/- (Rupees fifteen lakhs only) belongs to the Joint. Family is under the management of Sri Batchu Veerraju, the Respondent herein.

'n , 3. While so, their 2"'* Son Sri Batchu Kamaraju died on 05.01.2006 intestate leaving behind the Appellants herein. Later, i.e. on 06.3.2006, Sri Batchu Bhaskar Rao also died intestate. Subsequently Smt.Batchu Ramalakshmamma died intestate on 26.02.2017.

4. After the death of Sri'Batchu Kamafaju and Sri" Batchu'Bhask^^^ Rao, the Appellants herein requested Sri Batchu Veeraraju to partition the joint family properties. But, the said request was not accepted.

The VII Additional District Court (FTC), Kakinada, passed the Judgement and Decree Dt. 16.02.2012 declaring that the Appellants herein are entitled to 1/6^" share, the Respondent herein is entitled to 1/6^" share and Respondents 5 to 8 herein are entitled to 1/6^" share each in all the properties mentioned in the Plaint Schedule.

Aggrieved by the said Judgment and Decree dt.16.2.2012 in OS.No.64/2006, $1^{,\text{st}}$ Respondent herein filed A.S.No.764/2012. Challenging the said judgment and decree, the Appellants herein also filed AS.No.9/2014. In AS.No.764/2012, this Hon'ble Court granted an interim order dt.07.11.2012, directing "All further proceedings may go on, except passing of final decree". The said interim order is still in force.

At this juncture the elders and well-wishers of the family of Sri Batchu Bhaskara Rao advised all the parties to this Appeal to settle the disputes among us in a peaceful manner and divide the joint family properties in an amicable manner. Accordingly, we the Appellants herein and legal heirs of Sri. Batchu Kamaraju, younger son of Sri. Batchu Bhaskara Rao, the 1<sup>st</sup> respondents herein, who is the elder son of Sri. Batchu Bhaskara Rao, and the respondents 6 to 8 herein, who are the daughters of Sri. Batchu Bhaskar Rao, compromised and settled our over the above mentioned movable and immovable properties of our Joint Family subject to the following terms

All the disputes in the present appeal are settled to the satisfaction $12.$ and full and final settlement of all the claims of all the parties to this appeal over the movable and immovable properties of the joint family mentioned above. Hence, it is humbly prayed that this Hon'ble Court may be pleased to pass Decree and Judgement in the above appeal by recording the terms of Memorandum of Compromise dated 27-03-2023 and the Partition Deed bearing Document No.2536/2023 dt.17.03.2023 registered at the office of the Joint Sub-registrar, Pithapurams.
