THE HON'BLE SRI JUSTICE DUPPALA VENKATA RAMANA CRIMINAL PETITION No.16810 of 2016

ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. by the petitioners/A.1 and A.2, seeking to quash the proceedings in Crime No.202 of 2016 of Muvvalavani Palem Police Station, Visakhapatnam City, registered for the offence under Sections 406, 341, 426, 506 read with 34 IPC.

  1. None appeared on behalf of the petitioners.

  2. At the time of hearing, learned Assistant Public Prosecutor, on instructions, would submit that the in the above crime, investigation was completed, charge sheet was filed and numbered as C.C.No.2684 of 2019 and filed a copy of the letter submitted by the Inspector of Police, Muvvalapalem Police Station, Visakhapatnam City, to that effect.

  3. In that view of the matter, nothing survives in keeping the petition pending for adjudication, which is filed seeking quash of FIR. Therefore, recording the submission of the learned Assistant Public Prosecutor, the Criminal Petition is dismissed as infructuous. However, the petitioners are at liberty to file a fresh petition seeking quash of charge sheet, if they feel aggrieved by the same. Pending applications, if any, shall stand closed.
