Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, order or direction mostly one which is in the nature of a Writ of Mandamus declaring the action of the 2nd Respondent in placing the land admeasuring an extent of 0.70 cents in Sy.No.364 of Palempalli Village, Kadapa Mandal. YSR Kadapa District in the prohibitory list under Section 22- A(1)(b) of the Indian Registration Act, 1908 is arbitrary, illegal, irregular, violative of Articles 14 and 300-A of Indian Constitution, unjustified and unsustainable and consequently direct the Respondents to delete the land admeasuring an extent of 0.70 cents in Sy.No.364 of Palempalli Village, Kadapa Mandal. YSR Kadapa District from the prohibitory list under Section 22-A $(1)(b)$ of the Registration Act, 1908.

The petition coming on for heating, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of Sri SODUM ANVESHA Advocate for the Petitioner and of GP FOR REVENUE Advocate for the Respondent Nos. 1 to 5 and the Court made the following.

"Heard Mr.P.Veera Reddy, learned Senior Counsel appearing for the petitioner. Also heard the learned Assistant Government Pleader for Revenue, who contends that the petitioner has to file an application for the deletion of subject matter land from the Prohibited Property List.

As seen from the material on record, the petitioner filed a suit seeking permanent injunction against the respondents in O.S.No.415 of 1997 on the file of the Court of the III Additional Junior Civil Judge, Kadapa and the said suit was decreed by Judgment dated 19.07.1999. It appears that subsequently the petitioner's property has been included in the Prohibited Property List. The matter needs to be examined. However, in view of the undisputed position that the petitioner is in possession of the subject matter property, there shall be interim direction as prayed for.
