THE HON'BLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY WRIT PETITION No.37159 of 2022

ORDER:-

This Writ Petition for a mandamus is filed to declare the inaction on the part of respondents 2 and 3 in including Sri Krishna Chaitanya School of Nursing, Madanapalle, in the list of colleges for counseling for the course of General Nursing and Midwifery for the academic year 2022-23 by considering the representation, dated 04.11.2022, submitted by the petitioner, as illegal and consequently sought direction to respondents 2 and 3 to consider the said representation, dated 04.11.2022.

Heard learned counsel for the petitioner and learned Government Pleader for Medical, Health and Family Welfare.

The petitioner is a Society registered under the Societies Registration Act in the name and style "Vagdevi Educational Society". It has been running the educational institution in the name and style "Sri Krishna Chaitanya School of Nursing" in Madanapalle. The petitioner has submitted a representation, dated 04.11.2022, to respondents 2 and 3 to include the said Sri Krishna Chaitanya School of Nursing in the list of colleges for counseling for the course of General Nursing and Midwifery for the academic year 2022 – 23.

The grievance of the writ petitioner is that the said representation, dated 04.11.2022, of the petitioner is not being considered by the respondents 2 and 3. Therefore, the petitioner is before this Court by way of filing this Writ Petition seeking the aforesaid relief.

Learned Government Pleader for Medical, Health and Family Welfare would submit that the licence that was earlier granted to the petitioner to run the said educational institution is only for a period of two years and as the said period elapsed now that the petitioner has to submit proposals either for renewal or apply for fresh grant of licence.

The grievance of the petitioner is that his representation is not being considered. The respondents 2 and 3 have to consider the said representation and pass appropriate orders according to law on it, if it is found that it is not a valid representation. But they cannot keep the representation pending without being considered and more particularly when the academic year for the year 2022 – 23 is approaching fast.

Therefore, in the said facts and circumstances of the case, the Writ Petition is disposed of with a direction to respondents 2 and 3 to consider the representation, dated 04.11.2022, and pass appropriate orders on it in accordance with law, within a week from the date of this order i.e., on or before 26.11.2022. No costs.

Miscellaneous petitions, if any pending, in the Writ Petition, shall stand closed.
