WRIT PETITION No.36562 of 2022

ORDER:-

This writ petition for Mandamus is filed to declare the action of the respondent Nos.4 and 5 in making an attempt to highhandedly demolish the dwelling houses of the petitioners which are situated in the land covered by Sy. No.68/5-2 and T.S.No.69 in Bapuji Nagar, Hindupur Town, Sri Satya Sai District, without following due process of law, as illegal and consequently sought direction to the respondents not to demolish the houses of the petitioners.

Learned Assistant Government Pleader for Revenue appearing for respondents 1 to 4 on instructions would submit that the 4th Respondent, Tahsildar did not make any attempt either to demolish the houses of the petitioners in the said plots or to evict them from the said plots as contended by the petitioners and that no proposal is pending for assigning the said land to any third parties as contended by the petitioners. It is stated that writ petition is filed on hypothetical grounds. The said written instructions received by him from the 4th respondent is also placed on record.

Sri N. Ranga Reddy, learned Standing Counsel for respondent No.5 also on instructions would submit that respondent No.5 never made any effort to demolish the houses in question or to evict the petitioners. He would submit that if at all it necessitates to take any action for demolition of the said houses in future that the 5th respondent would follow the due process of law.

Therefore, recording the aforesaid submissions made by learned Assistant Government Pleader for Revenue appearing for respondents 1 to 4 and learned Standing Counsel for respondent No.5, this Writ Petition is closed. No costs.

Miscellaneous petitions, if any pending, in the Writ Petition, shall stand closed.
