Petition under Section 389 (1) of Cr.P.C praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to release the Petitioners on bail after suspending operation of the sentence imposed in SC.No.33/ 2017, dated 31-10-2022 on the file of the Special Judge for Trail of offences Under SC & ST (POA) Act, Prakasam Division, Ongole, pending disposal CRLA No.522 of 2022, on the file of the High Court.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of SRI P NAGENDRA REDDY Advocate for the Petitioner/Appellants and of PUBLIC PROSECUTOR for the Respondent, the Court made the following ORDER:
"Sentence of imprisonment imposed by the Court below alone is suspended pending disposal of the Criminal Appeal. The petitioners 1 to 3 shall be enlarged on bail on each of them executing a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with two sureties for the like sum each to the satisfaction of the learned Special Judge for Trail of Offences under the SCs & the STs (POA) Amendment Act, 2015-cum-VII Additional District & Sessions Judge, Prakasam District at Ongole".
