Heard the learned counsel for the petitioner
and learned Assistant Government Pleader for
Revenue, who placed a copy of the remarks dated
$09.11.2022$ of the 4 <sup>th</sup> respondent, for perusal of
this Court.
Earlier by virtue of the orders dated
03.10.2018 in Writ Petition No.35619 of 2018, the
4 <sup>th</sup> respondent issued an endorsement to the effect
that pending further orders, land in survey
No.151/9 to an extent of Acs.2.03 cents is kept
under Dispute Register. The said writ petition was
dismissed as withdrawn by order dated 15.9.2022.
In view of the same, the petitioner made an
application dated 17.10.2022 for deleting the said
land from the Dispute Register. The<br>4 <sup>th</sup>
respondent, instead of deleting the said land from
the Dispute Register, issued proceedings dated
24.10.2022, <i>inter alia</i> stating that the land in
survey No.151/9 with Khata No.1059 of Tamaram
Revenue Village is subject matter in O.S.No.124 of
2019<br>on the file of the Court of the Senior Civil
Judge, Narsipatnam, and in view of the same,
further action was taken as per the orders of the
Court.
As seen from the remarks referred to above,
no injunction appears to have been granted in the
said<br>suit,<br>in<br>the<br>absence<br>of<br>which,<br>more
particularly, in view of the dismissal of the Writ
Petition No.35619 of 2018, in the prima facie view
of this Court, the impugned proceedings is not
sustainable.
Accordingly,<br>there<br>shall<br>be<br>interim
suspension of the proceedings dated 24.10.2022 of
the 4th respondent, as prayed for.
List the matter after four weeks.
