The learned Senior Counsel appearing for
the petitioner has submitted that the District
Collector has to submit report to the State
Government<br>on<br>the<br>objections<br>of<br>the<br>land
owners and the decision of the Government on
the objections vide under Section<br>15(2) of the
Right to Fair Compensation and Transparency
in<br>Land<br>Acquisition,<br>Rehabilitation<br>and
Resettlement<br>Act, 2013(for short 'The Act')
shall be final. Thus, the impugned proceedings
of<br>the<br>2nd<br>respondent
dated 18.09.2022 is without jurisdiction and
contrary to the provisions of Sections 15(2) and
15(3) of the Act. He further submits that<br>no

reasons are mentioned in the rejection order of the 2nd respondent dated 18.09.2022 except stating that the request of the land holders are non-technical in nature and hence rejected.

The learned counsel for the petitioner further contends that while granting permission, the petitioner was required to set apart an extent of 3.80 meters to the municipality for road widening and he has constructed commercial building and hospital strictly as per the approved plan. Now, the proposal is only for widening of 51660 sq.feet. When, that is the case, the area which was kept vacant by the petitioner i.e., 3.80 meters is sufficient.

Hence, in view of the submissions of the learned counsel for the petitioner, the respondents are directed to maintain status-quo as on today in all respects, pending further orders.

Post after three(3) weeks.
