THE HONOURABLE SRI JUSTICE D.RAMESH

WRIT PETITION No.32642 of 2022 ORDER:

The Writ Petition under Article 226 of the Constitution of India is filed seeking to declare the action of the 2nd respondent in proceeding with 6-A enquiry without releasing seized stock to the petitioner as illegal and arbitrary and consequently direct respondent Nos.2 to 4 to release the seized rice to the petitioner.

  1. The petitioner has filed a claim petition before the 2nd respondent on 23.07.202 to release the seized stock. But the 2nd respondent has not considered the same and not released the seized stock. Aggrieved by the same, the present Writ Petition is filed.

  2. Though lapse of eight months, the respondents have not filed their counter.

  3. In view of the above, the Writ Petition is disposed of, directing the respondents to conclude the 6-A proceedings within a period of one(1) month from the date of receipt of copy of this Order. If the respondents failed to conclude the proceedings, they are further directed to release the seized stock to the petitioner on furnishing the 3rd party immovable property security to the value of the seized stock. There shall be no order as to costs.

Miscellaneous petitions, pending if any, in this Writ Petition shall stand closed.
