ORDER:

Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor representing the respondents.

  1. This Criminal Petition is filed under Section 482 read with 457 of the Criminal Procedure Code, 1973, seeking a direction

n to the respondents to release the petitioner's Motor Cycle bearing Registration No.AP 05 ER 6087 (White Colour Suziki Access), which was seized in connection with F.I.R.No.55 of 2022 on the file of the Station House Officer, Draksharama Police Station, East Godavari District, registered for the offences punishable under Section 34-A of A.P. Excise (Amendment) Act.

  1. In view of the submissions made and on perusal of the entire material on record, without going into the merits of the case, the petitioner is given liberty to approach the concerned authority by filing appropriate application/ petition for release of vehicle, within a period of one week, from the date of receipt of a copy of this order and on such application being filed, the concerned authority shall pass appropriate orders, within a period of three days thereafter and communicate the same to the petitioner.

  2. Accordingly, the Criminal Petition is disposed of.

As a sequel, miscellaneous applications, pending if any, shall stand closed.
