Petition under Section 482 of Cr.P.C is filed praying that in the circumstances stated in the Memorandum of grounds filed in support of the Criminal petition, the High Court may be pleased to stay all further proceedings in FIR No.206 OF 2019, Dated 22-08-2019 on the file of Anantapur II Town Police Station, Anantapur District. Pending disposal of CRLP 7726 of 2022, on the file of the High Court.
The Petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of RAJA REDDY KONETI Advocate for the Petitioners, PUBLIC PROSECUTOR, for the Respondents, The Court made the following.
ORDER:
Post on 20.01.2023.
Sri K.Raja Reddy, learned counsel for the petitioners submits that the charge sheet that is said to have been filed in the case was not found in the records when the counsel appearing for the petitioners had verified in the trail Court.
The learned counsel for the petitioners submits that the investigating officer is now taking steps to arrest the petitioners.
In view of the earlier submission made by the learned Public Prosecutor that a charge sheet had already been filed, it is clear that the investigating officer had not deemed it fit to arrest the petitioners before the filing of the charge sheet. In such circumstances, seeking arrest of the petitioners now would not be appropriate.
Accordingly, no coercive steps including arrest of the petitioners shall be undertaken by the investigating officer, pending further orders.
