THE HONOURABLE SRI JUSTICE D.V.S.S. SOMAYAJULU WRIT PETITION No.30458 OF 2021
ORDER:
Heard the learned counsel for the petitioners and learned Assistant Government Pleader.
The entire issue in this case is with respect to the assignment said to have been issued to the petitioners.
Learned counsel for the petitioners states that the patta was issued on 02.04.1954 to the petitioner i.e., prior to 18.06.1954 and therefore, the property cannot be kept under the prohibited properties under Section 22-A of the Registration Act. However, the Act itself provides solution to the problem.
The petitioners are directed to make an appropriate application before the District Collector, Chittoor District, who is in possession of all the records pertain to assignments, etc., to decide whether the assignment was made prior to 18.06.1954 or not. On an appropriate application made by the petitioners, the District Collector, Chittoor District, is directed to consider the case on its own merits and dispose of the same in accordance with law, within 30 days from the date of receipt of a copy of this order. It is left open to the petitioners to pursue their remedies after the order is passed, if necessary.
With these observations, the Writ Petition is disposed of. There shall be no order as to costs.
As a sequel, miscellaneous applications, pending, if any, shall also stand closed.
