Heard and perused the material available on record.

2. Challenge in the present appeal preferred under Section 54 of the Land Acquisition Act, 1894 [hereinafter referred to as 'the Act'] is to the Order, dated 26.08.2011 passed by the Court of the learned Senior Civil Judge, Nandikotkur, in LAOP.No.l89 of 2008.

The land acquisition authorities by pressing irito service the provisions of the Act issued ^a notification under Sub-Section (1) of Section 4 of the Act, proposing to acquire the land of the claimant admeasuring Ac.2.41 cents in Sy.No.761/3A2 of Talamudipi Village, Midthur Mandal, Kurnool District, along with other lands, for the purpose of widening SRBC. The Land Acquisition Officer in respect of the land of the respondent - claimant granted an amount of Rs.65,000/- per acre towards compensation. Being

dissatisfied with the said quantum, the respondent herein raised a protest and the same landed before the Reference Court, i.e., the Court of the learned Senior Civil Judge, Nandikotkur, vide LAOP.No.l89 of 2008. The learned Senior Civil Judge vide order dated 26.08.2011 enhanced the compensation from Rs.65,000/- per acre granted by the Land Acquisition Officer to Rs. 1,60,000/- per acre. Challenging the validity and legal sustainability of the aforesaid enhancement, the State is before this Court by way of the present appeal.

4. According to the learned counsel for the appellant. the order passed by the learned Senior Civil Judge is highly erroneous, contrary to law, weight of evidence and probabilities of the case. It is further submitted that the learned Reference Judge did not properly consider the oral and documentary evidence available on record. It is also submitted that the learned Judge also grossly erred in relying upon the documents submitted by the claimant.

5. In the above background, the points that arise for consideration of this Court in the present appeal are:

• (1) Whether the order passed by the Reference Court under Section 18 of the Act, which is impugned in the present appeal, is sustainable and tenable?
• the impugned order warrants any interference of this Court under Section 54 of the Land Acquisition Act, 1894? (2) Whether

A perusal of the material available on record discloses that on behalf of the claimant, PWsl to 3 were examined and Exs.Al to A4 were marked whereas on behalf of the State, RWl - Land Acquisition Officer was examined and Ex.Bl - Award copy was filed. It is further clear from the order impugned in the appeal that the learned Senior Civil Judge apart from taking into consideration the evidence of PWsl to 3 as regards potentiality of the lands also took into consideration the documents i.e., Exs.A3 &, A4. Exs.A3 8g A4 are the orders passed by the Composite High Court of Andhra Pradesh in LAAS.Nos.759 & 853 of 2007 and LAAS.Nos.33 ⁸⁶ 34 of 2006. The lands covered by the said documents are also situated at Talamudipi Village, Midthur Mandal, Kurnool District and the land in the present case so also the lands covered by Exs.A3 ⁸⁶ A4 are situated adjacent to each other.

AVSSJ & AVRBJ LAAS 281 2012

It is also not in dispute that the farmers used to irrigate the subjects lands by drawing water from SRBC and used to raise commercial crops also and as regards the fertility of the land, there is absolutely no controversy. It is also very much clear from a reading of the impugned order that duly taking into consideration the amounts fixed by the Composite High Court of Andhra Pradesh in Exs.AS & A4 documents, the learned Judge enhanced the compensation from Rs.65,000/- and Rs. 1,60,000/- per acre. Having regard to the convincing and cogent reasons assigned by the learned Reference Judge in the impugned order, this Court is not inclined to meddle with the said order.

7. For the afore-said reasons, the Appeal is dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this case, shall stand closed.
