THE HON'BLE SRI JUSTICE D. RAMESH
WRIT PETITION NO.30200 of 2022 ORDER:-
This Petition under Article 226 of the Constitution of India is filed seeking to direct the respondents to conduct survey and fix boundaries to petitioner's lands.

Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue appearing for the respondents.

During hearing, learned counsel for the petitioners contends that the petitioners are the absolute owners of the subject property and they have filed F-line application requested for conducting survey and fix boundaries in respect of the subject property. Thereafter, the 4th respondent has issued an endorsements dated 17.01.2022 and 18.01.2022 declining to conduct survey and fix boundaries for petitioner's lands alleging that the petitioners are not in possession and enjoyment of their respective lands. Aggrieved by the same, the present Writ Petition is filed.

Considering the submissions of the learned counsel for the petitioner and on perusal of the record, this Writ Petition is disposed of setting aside the impugned endorsements dated 17.01.2022 and 18.01.2022 issued by the 4th respondent and the matter is remanded back to the 4th respondent for fresh consideration. The 4th respondent is directed to consider the matter afresh and pass appropriate order within a period of four(4) weeks from the date of receipt of copy of this order. No costs.
Miscellaneous Petitions, if any pending, in this Writ Petition, shall stand closed.
