WHEREAS the Petitioner above named through their Advocate Sri JYOTHI RATNA ANUMOLU presented this Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to pass an order or orders or direction more particularly one in the nature of a writ of mandamus declaring that the impugned Notice bearing Rc.No.1079/2020 dated 12.02.2021and 16.11.2021 by the 4^th Respondent and the consequent proceedings therein for updating the revenue records in respect to land situated in carved out respective survey no's from Sy.No.287/1 287/1A2, 287/A2D, 287/1A2A, 287/1A2B, 287/1A2C, 287/1B totally admeasuring Ac.11.34 Cents of Kozo Village, Managalagiri Mandal, Guntur District, herein as without jurisdiction, illegal, arbitrary and violation of the Provisions of AP Record of Rights in Land and Pattadhar Passbooks Act, 1971 (ROR), besides being violation of petitioners rights guaranteed under Art.14, 21 and 300A of the Constitution of India and to consequently set aside the same.

AND WHEREAS the High Court upon perusing the petition and affidavit filed herein and upon hearing the arguments of Sri JYOTHI RATNA ANUMOLU Advocate for the Petitioner and GP for Revenue for Respondent Nos.1 to 4, directed issue of notice to the Respondents herein to show cause as to why this WRIT PETITION should not be admitted. You viz:

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to suspend Impugned Notice bearing Rc.No.1079/2020 dated 12.02.2021 and 16.11.2021 and the consequent proceedings therein issued by the 4^th Respondent for updating the revenue records in respect to land situated in Sy.No.287/1 287/1A2. 287/A2D, 287/1A2A, 287/1A2B, 287/1A2C, 287/1B admeasuring Ac.11.34 Cents of Kaza Village, Mangalagiri Mandal, Guntur District and to stay all further proceedings 4^th Respondent pursuant to the impugned Notice before the bearing Rc.No.1079/2020 dated 12.02.2021 and 16.11.2021, pending disposal of WP No. 29872 of 2022, on the file of the High Court.

The Court made the following: ORDER:

"Notice before admission.

The present writ petition is filed questioning initiation of proceedings by the 4^th respondent in Rc.No.1079/2020, dated 12.02.2021 and 16.11.2021.

The learned counsel for the petitioners submitted that initiation of proceedings is contrary to the provisions of the Act specifically as per Sections 8(1) and 8(2) of the ROR Act. Already, the competent civil Court has declared that it is not waqf property, more so, the 4^th respondent has no jurisdiction to initiate the proceedings.

Considering the submissions made by both the counsel, there is stay of all further proceedings pursuant to the impugned notice dated 12.02.2021 and 16.11.2021.
