ORDER:

Heard the learned counsel for the petitioners, the learned Government Pleader for Land Acquisition for the respondent no.4 and the learned Government Pleader for Finance for the respondent no. 2.

  1. The grievance of the Writ petitioners is that the respondent nos. 2 to 4 have not considered the representation of the petitioners dated 03.03.2022 for payment of compensation in the matter of acquisition of the land in an extent of Ac.0.26 cents in Sy.no. 177/3, Ac. 0.18 cents in Sy.no. 177/11, Ac. 0.29 cents in Sy.No. 177/6, Ac. 0.23 cents in Sy.No. 177/7, Ac. 0.22 cents in Sy.no. 177/9, Ac. 0.22 cents in Sy.No. 177/8 and Ac. 0.21 cents in Sy.No. 177/14 of Krishnampalli Village (reach number 3), Yerpedu Mandal, Chittoor District.

  2. The learned counsel for the petitioners submits that the petitioners' lands were acquired by the respondents in different extents for different survey numbers as mentioned above without paying any compensation on the ground that it is required for the public purpose. Then the petitioners made a representation dated 03.03.2022 to the respondent nos. 2 to 5. Since there is no progress in the matter, this Writ Petition is filed.

  3. On the other hand, the learned Government Pleader for Land Acquisition upon the written instructions of the 4th respondent submits that the new CFMS bill no. 2022-289589 was generated in CFMS portal and the same was rejected due to technical problem on 05.05.2022. Then the bill was resubmitted in CFMS on 20.05.2022 vide CFMS no. 2022- 601301 and it was sent to the Assistant Pay and Accounts Officer, Works and Project-1 and the bill was also approved

on 24.05.2022. Thus the ex-gratia proposals were approved for a sum of Rs. 25,26,772/- (Rupees Twenty Five Lakh, Twenty Six thousand Seven Hundred and Seventy Two only).

  1. The learned Government Pleader for Finance appearing for the 2nd respondent also submits that the bills are pending with the 2nd respondent and the said amount will be released to the petitioners in due course.

  2. In view of the above said facts and circumstances, the respondent nos. 2 to 4 are directed to consider and dispose of the petitioners' representation dated 03.03.2022 by releasing the ex-gratia amount sanctioned as mentioned above as expeditiously as possible within a period of six (6) weeks from the date of receipt of this order.

  3. Accordingly, the Writ Petition is disposed of. No costs.

As a sequel, Miscellaneous Petitions pending, if any, shall stand closed.
